These terms and conditions (“Terms”) govern your use of Find My Captain (“Find My Captain,” “we,” “us”) — a marketplace that connects vessel owners with captains, crew, and vendors (the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
Who can use the Service
You must be at least 18 years old and able to enter a binding agreement. You agree to provide accurate information and to keep your account details current.
Your account
You’re responsible for activity under your account and for keeping your login credentials secure. Tell us right away if you suspect unauthorized use.
The marketplace
Find My Captain is a platform that helps owners and maritime professionals find each other. We are not a party to the agreements or services arranged between users, and we are not an employer, agent, or broker of any captain, crew, or vendor. Owners and professionals are solely responsible for their own conduct, qualifications, vessels, and the services they arrange and perform.
Verification
We may review licenses, sea time, and references and may mark certain accounts as verified. Verification reflects checks we perform but is not a guarantee — you’re responsible for satisfying yourself that anyone you work with is suitable for the job.
Bookings and conduct
When you request, accept, or carry out a booking, you agree to deal honestly and to follow applicable maritime, safety, and local laws. You won’t use the Service to harass, defraud, or harm others, or to arrange anything unlawful.
Membership
Some features require a paid membership. Any fees, billing frequency, and free-trial terms are presented to you at sign-up and processed by our payment provider. By subscribing, you authorize recurring charges until you cancel. You can cancel anytime from your account; cancellation stops future charges and takes effect at the end of the current billing period.
Text-message notifications
Mobile notifications are optional and opt-in. If you verify a mobile number and enable SMS, you consent to receive transactional text messages about your bookings and account. Message and data rates may apply. Reply STOP to opt out or HELP for help, or manage your number in Communications settings. See our privacy policy for details.
Acceptable use
- Don’t misuse, disrupt, or attempt to gain unauthorized access to the Service.
- Don’t post false, misleading, infringing, or unlawful content.
- Don’t scrape, copy, or resell the Service or its data without permission.
Content
You keep ownership of the content you submit, and you grant us a license to host and display it as needed to operate the Service. You’re responsible for the content you provide and confirm you have the rights to share it.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind. We don’t warrant that the Service will be uninterrupted or error-free, or that any captain, crew, vendor, or owner will meet your expectations.
Limitation of liability
To the fullest extent permitted by law, Find My Captain isn’t liable for indirect, incidental, or consequential damages, or for the acts, omissions, or services of any user. Our total liability relating to the Service is limited to the amount you paid us, if any, in the 12 months before the claim.
Indemnification
You agree to indemnify and hold Find My Captain harmless from claims arising out of your use of the Service, your content, or your dealings with other users.
Governing law
These Terms are governed by the laws of United States of America, without regard to conflict -of-laws rules. Disputes will be resolved in the courts located there, unless otherwise required by law.
Changes to these Terms
We may update these Terms from time to time. We’ll revise the “last updated” date above, and your continued use of the Service after changes take effect means you accept the updated Terms.
